Rechazan recusación y Walter Bento permanecerá detenido, afirman las juezas según una resolución emitida este lunes 08 de abril.
Las juezas del Tribunal Oral Federal N° 2 de Mendoza (TOF 2), Gretel Diamante, María Carolina Pereira y Eliana Rattá Rivas, han rechazado contundentemente la recusación presentada por la defensa del ex juez federal destituido Walter Bento.
En una resolución judicial emitida este lunes, las magistradas desestimaron el planteo, destacando que la demanda carece de fundamentos legales sólidos y no admite discusión.
La resolución detalla que el rechazo es «in limine», lo que términos jurídicos significa describir el rechazo de una demanda que no merece ni siquiera ser debatida, al ser manifiestamente infundada y contraria al derecho.
El pasado viernes, los abogados de Bento habían solicitado su liberación inmediata y luego recusaron a las juezas, alegando un «temor de parcialidad» basado en ciertas decisiones del tribunal.
Sin embargo, las juezas rechazaron estas sospechas, afirmando que la detención de Bento es legal y que la orden de arresto sigue vigente ya que no ha sido anulada por la Cámara Federal de Casación Penal.
En su resolución, las magistradas criticaron la estrategia de la defensa de Bento, señalando que la recusación no es el mecanismo adecuado para expresar su disconformidad con las decisiones judiciales.
Asimismo, advirtieron sobre el uso excesivo de las recusaciones como una táctica para apartar a los jueces naturales según la conveniencia de las partes, lo cual consideran inaceptable.
Además, resaltaron que la doctrina de la Corte Suprema de Justicia sostiene que las recusaciones manifiestamente inadmisibles deben ser rechazadas de plano.
En este caso, indicaron que la recusación presentada por la defensa de Bento es improcedente y debe ser desestimada in limine, según informó Diario El Sol.
Cabe mencionar que la semana pasada, la Cámara Federal de Casación Penal determinó, en una votación dividida, que el TOF 2 debe emitir un nuevo pronunciamiento sobre la detención de Bento. La decisión se fundamenta en el hecho de que la defensa había presentado un recurso de queja ante la Corte Suprema de Justicia, argumentando que la medida de detención no estaba firme.
