Desde hoy a las 7 de la mañana rige lo dispuesto en el Boletín Oficial sobre las nuevas medidas en la provincia hasta las 5.30 del martes 22. Luego, habrá que esperar las nuevas determinaciones del Ejecutivo.

A través del Decreto 1167, publicado el viernes en el Boletín Oficial, el Gobernador Rodolfo Suarez estableció las nuevas medidas que rigen en Mendoza desde las 7 de mañana sábado hasta las 5.30 del martes 22 de septiembre de 2020.
Restricción absoluta
En el artículo 1 se dispone en el marco de alerta sanitaria “la restricción absoluta de circulación en el ámbito territorial de la Provincia de Mendoza, desde las 16 del día domingo 20 de septiembre de 2020 hasta las 5.30 del día 22 de septiembre de 2020”.
Suspensiones del sábado
Además, se dispone “la suspensión desde el día sábado 19 del corriente a partir de las 7, de toda actividad en espacio público al aire libre, entendiéndose como tales a parques, plazas y demás espacios verdes, hasta el martes 22 a las 5.30”.
Exceptuados de circular
En este sentido, se detalla que están exceptuadas de circular “las personas que deban circular en alguna situación de emergencia médica debidamente justificada, compra en farmacias, expendio de combustibles y actividades consideradas esenciales. También queda exceptuada la actividad de las personas afectadas a servicios de entrega a domicilio en el horario autorizado”, de domingos a miércoles hasta las 23, y viernes y sábados hasta las 24.
Asueto administrativo y día no laborable
La norma establece que el día 21 de septiembre habrá asueto administrativo ya que por Ley Nº 7897 se establece el día 21 de septiembre de cada año como el “Día del trabajador de la Sanidad”, disponiendo su condición de “no laborable”, por tanto, en el ámbito de la salud pública se adoptan las medidas necesarias para asegurar las prestaciones indispensables del servicio de salud”.
Mientras, para el ámbito de la salud privada se establece como “día no laborable”.
Para el caso de la Administración Pública, se dispone de asueto “debiendo preverse las guardias que resulten imprescindibles”.
Se invita a los Poderes Judicial y Legislativo y a las Municipalidades a adherir al presente decreto en las partes pertinentes.
Sanciones
En el artículo 7 se detalla que “el incumplimiento de las obligaciones y restricciones establecidas como consecuencia del estado de “alerta sanitaria” debidamente constatado por agente público provincial y/o municipal, será sancionado con multa de pesos diez mil ($ 10.000) a la persona infractora y pesos cincuenta mil ($ 50.000,00) al propietario del local y/o domicilio donde la misma se constatare”.
Los municipios podrán controlar y sancionar, en forma concurrente con la Provincia, para hacer cumplir el decreto en sus respectivos ámbitos territoriales.
Prórroga del distanciamiento social, preventivo y obligatorio
En el artículo 9 se establece que desde las 5.30 del martes 22 de septiembre de 2020, “se prorrogan, y hasta tanto se emita una nueva norma modificando lo establecido en el presente decreto, las medidas adoptadas por Decreto Acuerdo Nº 1078/20, sus normas modificatorias y complementarias con las excepciones previstas en el presente”.
Restaurantes y cafés
“Los restaurantes y cafés, podrán funcionar en modalidad presencial con un límite de cuatro (4) personas por mesa y siempre que las mismas estén dispuestas al aire libre. A tal fin podrán colocar mesas en espacios al aire libre debidamente habilitados por disposición de la autoridad competente, anterior a la fecha de emisión del presente decreto. No podrán habilitarse nuevos espacios a los ya otorgados. En caso de patios o espacios internos, habilitados a la fecha del presente, deberán demarcar adecuadamente las circulaciones para evitar el entrecruzamiento de clientes que ingresan o se retiran. Podrán funcionar, en todos los casos, bajo la modalidad de delivery y ”pase y lleve”.

El artículo 11 menciona que “todas las personas que ingresen al territorio provincial, por cualquier medio de transporte o vía de ingreso, deberán realizar un período de aislamiento obligatorio hasta completar diez (10) días desde su ingreso, o el plazo que la autoridad sanitaria disponga, el que deberá ser cumplido en los hoteles y/o alojamientos que a tal fin determine la autoridad competente”.
